Nigeria church bomb death toll rises to 37, wounded 57 (Reuters)

ABUJA (Reuters) ? The death toll from a bomb attack on a church just outside Nigeria's capital Abuja on Christmas Day has risen to 37, with 57 people wounded, a source at the National Emergency Management Agency (NEMA) said on Friday.

The bombing at St. Theresa's Catholic church in Madalla on Abuja's outskirts during a packed Christmas mass, was the deadliest of a series of Christmas attacks on Nigerian churches and other targets by the militant Islamist sect Boko Haram.

"As of just now, the latest death toll from the bombing of St. Theresa's church is at 37. Wounded, we have 57," a senior NEMA official said. The initial death toll had been 27.

The official asked not to be identified because the victims were now in the hands of hospitals and morgues.

President Goodluck Jonathan summoned his security chiefs for an emergency meeting on Thursday to discuss the growing Islamist militant threat and how to deal with it.

This year was the second in a row that Boko Haram has attacked churches at Christmas. Its strikes are becoming deadlier and more sophisticated, and have raised fears that the militants are trying to ignite sectarian strife in country historically prone to conflicts between a largely Muslim north and Christian south.

Boko Haram, whose name means "Western education is sinful" in the northern Hausa language, has been blamed for a campaign of shootings and bombings against security forces and authorities in the north.

Attacks in and around the capital - including one on the U.N. headquarters in August that killed at least 24 people - suggest the group is trying to raise its profile and radiate out from its heartland in the northeast.

On Tuesday night, unidentified attackers threw a homemade bomb into an Islamic school in Nigeria's southern Delta state, in an apparent sectarian reprisal that wounded seven people, six of them young children.

On Wednesday night, an explosion in a local bar in the northern city of Gombe wounded one person, police said.

Facebook Pics Lead to Child Abuse Arrests

PHOENIX (Reuters) - Two Arizona parents were arrested by sheriff's deputies after apparently posting pictures on Facebook that showed their children, an infant and a toddler, bound with duct tape, authorities said on Thursday.

Coconino County deputies arrested Frankie Almuina, 20, and Kayla Almuina, 19, on suspicion of two counts of child abuse on Wednesday at their northern Arizona home after being alerted to the photos by an anonymous tip.

The children, a 2-year-old toddler and a 10-month-old infant, were seen online bound with duct tape on their wrists and ankles with their mouths taped shut, Commander Rex Gilliland told Reuters. One of the children was shown hanging upside down on an exercise machine.

The parents told investigators that the photos, posted on the mother's Facebook account, were a joke and that the children were not harmed, Gilliland said.

"It's clear in our minds that these children were placed in a very extreme situation," Gilliland said. "By the look on their faces, they were in sheer terror. I don't know how this could have been a joke."

Authorities were called to the scene after a person who likely knew the couple saw the postings and called the Arizona Child Abuse Hotline, Gilliland said. The caller knew the names of the parents and where they lived.

He said investigators seized about a dozen similar photos, some that were not posted online, from the home north of Williams, Arizona, about 175 miles north of Phoenix.

The couple were being held in a county jail as of late on Thursday. The children have been turned over to another family member, Gilliland said.

Woman knits scarves, shawls for cancer patients

LEE COUNTY, FL -

If idle hands are the devil's playground, Alice Newsom has a one way ticket to heaven.

For four years, the 91 year old knitter has knit 445 scarves and shawls in all different shapes and colors.

Every 33 hours she adds another to the growing pile in her Fort Myers home.

This month, Alice created 9 shawls, but they won't sit in her home for long.?

They'll end up in Susan G. Komen Project Hope Bags which are given to breast cancer patients.

Sandi Shank was diagnosed with breast cancer last year.

"It will make or break you," she said.

One of the first gifts she got before treatment was a Project Hope Bag.? Inside - her very own shawl.

After surgery, Shank's cancer is gone, but her shawl will stay with her forever.

With her eyesight slowly slipping, Newsom isn't sure how much longer she can knit.? But every stitch brings her one step closer to helping someone else.

"This is something they use every time they are in treatment and at home.? Every day they use my gift," said Newsom.

U.S. says China is not a currency manipulator (Reuters)

WASHINGTON (Reuters) ? The U.S. Treasury again shied away from labeling China a currency manipulator on Tuesday, but it rapped the country for not moving fast enough on exchange rate reforms.

Some U.S. politicians have argued that China has gained an unfair competitive edge in global markets by keeping the yuan artificially low to boost exports.

But the Treasury, in a semi-annual report, said that statutes covering a designation of currency manipulator "have not been met with respect to China."

Even so, Treasury said appreciation in the yuan has been too slow. The value of the yuan, which Beijing manages closely, has risen by 4 percent against the dollar this year and 7.7 percent since China dropped a firm peg against the greenback in June 2010.

"The movement of the (yuan) to date is insufficient," the Treasury said in a statement following the release of its semi-annual report to Congress on international economic and exchange rate policies.

"Treasury will closely monitor the pace of appreciation and press for policy changes that yield greater exchange rate flexibility, a level playing field, and a sustained shift to domestic demand-led growth."

The Peterson Institute for International Economics recently estimated the yuan was undervalued by 24 percent against the dollar, down from 28 percent earlier in the year. It attributed the change to both Beijing's policy of gradual currency appreciation and higher Chinese inflation.

MORE OF THE SAME

Treasury Secretary Timothy Geithner has said the law that requires the administration to determine whether U.S. trade partners are deliberately undervaluing their currencies is a poor tool to push Beijing on the yuan.

Instead, the United States has tried to use international economic fora, such as the Group of 20 leading nations and the International Monetary Fund, to ramp up pressure on Beijing to move more quickly to a more-flexible currency.

"It's not very surprising. It's sort of sliding it in under the radar. They're (Treasury) really not in a position to make any major moves at this point," said Sean Incremona, an economist at 4Cast in New York.

The Treasury Department has not labeled country a currency manipulator since July 1994, when it cited China. A designation would require the United States to step up negotiations with Beijing on the yuan's value.

The yuan slipped on Tuesday as strong dollar demand from corporations offset a record high mid-point fixed by the People's Bank of China. The central bank set an all-time high dollar/yuan mid-point in an apparent hope to let the yuan rise a little more at the end of 2011 so as to make the yuan's full-year nominal appreciation look bigger, traders said.

Royal Dutch Shell says Nigeria spill contained (AP)

ABOARD THE BONGA FLOATING OIL VESSEL ? The worst Nigeria offshore oil spill in more than a decade has been contained before reaching the West African nation's coast, officials with Royal Dutch Shell PLC said Monday, less than a week after one of its lines bled crude into the Atlantic Ocean.

An investigation into how the spill of less than 40,000 barrels ? or 1.68 million gallons ? happened remains ongoing, though company officials acknowledged workers only discovered the leak after seeing a sheen of crude in water surrounding its Bonga offshore oil field.

Meanwhile, Shell officials say the company will clean up another spill it discovered while containing its own ? highlighting how prevalent pollution remains in oil-stained Nigeria after more than 50 years of production.

"We can undeniably say we traced our oil ... and stopped it," said Cliff Pain, who manages the Bonga operation for a Shell subsidiary.

Shell organized a helicopter flight Monday for journalists to see the Bonga field ? controlled from a large ship as opposed to a stationary rig ? about 75 miles (120 kilometers) off Nigeria's coast. There, waters appeared free of the oil sheen as ships continued to patrol along the underwater lines linking the vessel to oil fields and transfer buoys for filling tankers.

The leak discovered Dec. 20 came from a break in a flexible line about 360 meters out from the vessel that sends oil to tankers, Pain said. While the vessel has a variety of gauges to check pressure on the line, it wasn't until daylight broke that workers noticed a sheen surrounding the Bonga vessel, he said.

It takes about 25 hours to fill a waiting tanker with 1 million barrels of oil from the vessel, Pain said. That means the leak could have spewed for hours before being noticed.

At its height, Shell statistics show the sheen spread across about 350 square miles (900 square kilometers), matching an estimate earlier issued by an independent watchdog group called SkyTruth. Nigerian government officials previously said the spill only affected an area a third that size

Using ships and aircraft, workers spread chemical dispersants to break up the oil, which also evaporated in the region's warm water and air, said Steve Keedwell, a Shell employee who helped oversee the cleanup operation. Shell ultimately stopped the sheen about 11 miles (18 kilometers) before it made landfall, Pain said.

However, workers then discovered a separate oil spill around the mouth of a river in Delta state, said Mutiu Sunmonu, Shell's Nigeria country chairman. Sunmonu said samples of the oil showed it came from a different source, though the company would clean it up as well.

"When I sighted it myself, my initial reaction was anger, but I told myself: 'You know, you just cannot afford to be angry, just deal with it,'" Sunmonu said.

The Nigerian group Environmental Rights Action, which monitors spills around Nigeria's oil-rich southern delta, has blamed Shell for the new spill. Nnimmo Bassey, the group's executive director, could not be immediately reached for comment Monday night.

Shell operates the Bonga field in partnership with Italy's Eni SpA, Exxon Mobil Corp., France's Total SA and the state-run Nigerian National Petroleum Corp. It produces about 200,000 barrels of oil a day ? around 10 percent of production in Africa's most populous nation. The field remains shut down and Shell officials offered no estimate Monday of when production could resume at a field vital to Nigeria's government finances.

Nigeria, an OPEC member nation producing about 2.4 million barrels of crude oil a day, is a top supplier to the United States. However, pollution from spilled oil stains its Niger Delta region, with crude lapping against beaches and leaving a black ring around creeks in an area about the size of Portugal.

Some environmentalists say as much as 550 million gallons of oil poured into the delta during Shell's roughly 50 years of production in Nigeria ? a rate roughly comparable to one Exxon Valdez disaster per year. Many blame Shell and foreign companies working in Nigeria for the pollution. However, Shell in recent years has blamed most of its spills on militant attacks or thieves tapping into pipelines to steal crude oil, which ends up sold on the black market or cooked into a crude diesel or kerosene.

Talking with journalists, Sunmonu acknowledged that the limited spill, open ocean and favorable weather had helped Shell quickly contain the spill. If it had been on land, the oil could have sunk into the soil, remaining there for years, he said.

It also would have pushed Shell into negotiations with village elders to clean up the spill, something it often contracts other companies to handle. Many view the company with hostility after its years in the delta, and its employees remain targets of kidnap gangs and militants.

"You don't have communities to contend with" on the ocean, Sunmonu said.

Yemen's Saleh vows to leave, troops kill 9 protesters

Yemeni President Ali Abdullah Saleh said on Saturday he would leave for the United States and give way to a successor, hours after his forces killed nine people demanding he be tried for killings over nearly a year of protests aimed at his ouster.

But Saleh, who agreed to step down last month under a deal cut by his wealthier neighbors who fear civil war in Yemen will affect them, did not say when he would depart and vowed to play a political role again, this time opposed to a new government.

The bloodshed and political uncertainty hinted at the chaos which oil giant Saudi Arabia and Saleh's former backers in Washington fear Yemen could slip into, giving the country's al Qaeda wing a foothold overlooking oil shipping routes.

Troops from units led by Saleh's son and nephew opened fire with guns, tear gas and water cannon against demonstrators who approached his compound in the capital Sanaa after marching for days from the southern city of Taiz, chanting "No to immunity!"

Mohammed al-Qubati, a doctor at a field hospital that has treated protesters during 11 months of mass demonstrations against Saleh, said some 90 people suffered gunshot wounds in addition to the nine killed. About 150 other people were wounded by tear gas canisters or incapacitated by gas, he said.

The marchers denounced the deal Saleh agreed last month giving him immunity from prosecution in exchange for handing power to his deputy, who is to work with an interim government including opposition parties before a February presidential election.

That plan, crafted by the Gulf Cooperation Council (GCC) and mirrored in the terms of a U.N. Security Council resolution, has been bitterly denounced by youth protesters who demand Saleh face trial and his inner circle be banned from holding power.

"The blood of the martyrs has been sold for dollars," shouted protesters, before forces from the Republican Guard and Central Security Forces attacked on roads leading to Saleh's compound, which was surrounded by tanks and armored vehicles.

ACTIVISTS ROUNDED UP

Saleh, who repeatedly backed out of the Gulf plan to nudge him from power before a June assassination attempt forced him into hospital in Saudi Arabia, said he would both let Yemen's new government work, and oppose it.

"I will go to the United States. Not for treatment, because I'm fine, but to get away from attention, cameras, and allow the unity government to prepare properly for elections," he said, adding he would undergo some medical tests.

"I'll be there for several days, but I'll return because I won't leave my people and comrades who have been steadfast for 11 months," he said. "I'll withdraw from political work and go into the street as part of the opposition."

Alluding to the relationship of his poor, populous country to its resource-blessed neighbors, he said: "An unstable Yemen means an unstable region. So, protect the security, unity and stability of Yemen, neighbor states; its security is yours."

A Yemeni online publication quoted the U.S. ambassador in Sanaa, Gerald Feierstein, describing the march as a provocative act, during a meeting with Yemeni journalists. The ambassador could not immediately be released for comment.

As Saleh spoke, a member of the bloc of opposition parties that share the cabinet with members of Saleh's party said security forces had rounded up dozens of people including Samia al-Aghbari, an activist in the anti-Saleh protest movement.

Aghbari sent a text message saying: "The Republican Guard is taking me and (another activist); they are dragging us by our clothes and shooting in the air."

Saleh's General People's Congress party said on Thursday that the protest violated the terms of the transition pact, under which the government is to oversee disengagement of his forces from rebel army units and tribal militias with whom they have fought in Sanaa and elsewhere.

Their battles, which the youth protesters regard as an internecine conflict among a criminal elite, have left parts of the capital and Taiz, 200 km (125 miles) to the south, in ruins and deepened a humanitarian crisis in a country with multiple, overlapping regional conflicts.

U.S. DRONE STRIKE IN SOUTH

Those include fighting with militant Islamists in the south, where Islamists have seized much of the territory in one province and have significant influence in another.

Saleh's opponents have accused him of ceding ground to Islamists to bolster his claim that he alone can check the Yemen-based branch of al Qaeda, which has planned abortive attacks abroad from Yemen.

A Yemeni security source said on Friday that a U.S. drone had killed a relative of the al Qaeda wing's leader in Abyan, the Islamist militant-held province where battles with government troops have cost at least 50 lives this week.

A CIA drone strike killed Anwar al-Awlaki, a U.S. citizen linked to Al Qaeda in the Arabian Peninsula, earlier this year.

Fighting in Abyan has forced tens of thousands of people to flee the province, compounding the humanitarian crisis in a country where about half a million people are displaced and oil exports that fund imports of staple foodstuff have mostly ceased during the struggle over Saleh's fate.

Elsewhere in southern Yemen, gunmen killed a Briton of Yemeni origin and wounded a soldier accompanying him in an attack on an oil company vehicle that a local official blamed on highway robbers.

In the southern port city of Aden, a grenade blast, apparently the work of feuding gangs, killed one person and wounded five at a market late on Friday, a local official said.

Separatist sentiment is running high in the south, formerly a socialist republic that fought a civil war with Saleh's north in 1994 after four turbulent years of formal union.

Mayor: Christmas house fire kills 5 in Connecticut

STAMFORD, Conn. ? A fire tore through the home of an advertising executive in a tiny neighborhood along the Connecticut shoreline Sunday, killing her three children and both of her parents on Christmas morning.

Madonna Badger, who bought the large Victorian home last year, was able to get out of the house, along with an acquaintance.

Stamford Police Sgt. Paul Guzda said Badger?s three daughters ? a 10-year-old and 7-year-old twins ? were killed. He said her parents, who were visiting for the holiday, also died. Police officers drove Badger?s husband, Matthew Badger, from New York City to Stamford on Sunday morning.

Guzda said the male acquaintance was a contractor who was doing work on the home. Badger, an ad executive in the fashion industry, is the founder of Badger & Winters Group. A supervisor at Stamford Hospital said she was treated and discharged.

Neighbors awakened to the sound of screaming and rushed outside to help, but they could only watch in horror as flames devoured the grand home in the pre-dawn darkness and the shocked, injured survivors were led away from the house.

?It is a terrible, terrible day,? Mayor Michael Pavia told reporters at a news briefing at the scene of the fire. ?There probably has not been a worse Christmas day in the city of Stamford.?

The fire was reported shortly before 5 a.m. Firefighters were able to rescue Badger and another adult from the house in Shippan Point, a neighborhood that juts into Long Island Sound, Acting Fire Chief Antonio Conte said.

?We had our hands full from the moment we arrived on the scene,? he said.

Firefighters knew there were other people in the home but could not get to them because the flames were too large and the heat too intense, Conte said, his voice cracking with emotion.

?It?s never easy. That?s for sure,? he said. ?I?ve been on this job 38 years ? not an easy day.?

Conte said fire officials don?t yet know the cause of the blaze and likely won?t get clues for a few days until fire marshals can enter the structure.

By Sunday evening, the roof of the blackened house had largely collapsed. A spokesman for Stamford Hospital said one of the survivors was listed in fair condition; he did not know the condition of the other.

A neighbor, Sam Cingari Jr., said he was awakened by the sound of screaming and saw that the house was engulfed by flames.

?We heard this screaming at 5 in the morning,? he said. ?The whole house was ablaze and I mean ablaze.?

Oh man oh man oh man, a wild west roleplay. Pfauxmeh, you have answered my prayers.

I would love to play the navigator. May I? It's going to be amazing. I will write up my character and submit him at once, for he has just sprung fully-formed into being.

A couple questions that may affect backstory or his particular details:
Where/when do we begin? Is she recruiting when we begin, or do we have our team and are ready to set out?
Could you give a specific year this takes place, or are we going with generic wild west movie era?

DO WANT.

I have a lovely gunslinger that could be used as a protection character, if you'll have her. She's made for a more fantasy setting but its all too easy to take that away and make her into something realistic. I adore Wild West settings and this looks so promising.

Well, it's been a while since I've been involved in a western that didn't flounder within the first tens of posts... Besides, I need a change of scenery, and this legitimately looks interesting, and the song hooked me.

That being said, I'm probably going to end up as one of the "Protection" fellows, if by protection you mean the Clint Eastwood style badass cowboys. Note, I may or may not being playing that type, just using it as an example. Also~ What is a "Helper" exactly?

Well, I submitted Jeremy Fuller for your approval. He may need a little convincing since he really doesn't take women seriously, but he'll be sorely tempted by the challenge, and you won't find a better navigator in Jerome.

Aaaaand... it's not till I typed that that I realized his name's pretty similar to the town. Oh well.

I am still interested to know the specific year we'll be playing in, 'cause it will affect whether or not he can quote Pirates of Penzance, or how famous Charles Darwin has become, or if he's been published at all. (Edit: Just looked it up, and Jerome wasn't even a town until 1883, and between then and 1903 it became "the wickedest town in the West"! Thank you, Wikipedia!)

I am totally debating making a badass lady preacher protectionist, merely just to piss Jeremy right the hell off.

Like, seriously. It's been forever since I've tried to preacher angle (Paladins on the other hand...) and the lady bit is because.. Well, I've found myself using a lot of lady characters lately... I have no idea why...

User avatar
Talisman

Ahahaha, your potential badass lady preacher would cause many potential harrumphs from Jeremy, and more than one potential scientific lecture on the improbability of intelligent design. Potentially.

User avatar
Slorfae
Member for 0 years

Yeah, I can totally see it now! Right in the middle of the potential lecture, Preacher lady would potentially shove a gun into Jeremy's face, recite a badass bible verse followed by a potentially epic quip (Preferably one about the "intelligent design" of lecturing an armed woman), and pull the trigger and reveal that that chamber was empty. Potentially.

Well, there sure is a lot of potential here if I say so myself.

That being said, if I do go for the badass preacher trope, I will have a reasonable backstory and some characterization thrown in the mix. Being rough like that for only the sake of mere badassry isn't isn't cool, need's some reasons as to why. I'm seeing her being a bandit, something bad happens, finds God, and has trouble adjusting to a pious life. Yes, yes, I can work with this.

If Pfauxmeh can work with two female protectors... I am still unsure about her being female... Eh, I'll sleep on it, see how other characters turn out.

Hahaha~! All of this interest in my role play makes me ecstatic.

First, I'll answer some questions:
-Wikipedia is awesome. There's no set "year"...was thinking maybe a couple of years after it's formation? 1885. How about that?
-I already have one protectionist accepted, however that preacher lady would be perfect for my "helper" role...the helper was just meant for anything we could think of, such as comic relief or even just an extra set of hands to carry things. I love the idea, so DOOOO it!
-We start where I left off: Lila Mae is recruiting, although she hasn't quite made it obvious yet...maybe the poker players at the other table know something is up...? ;)

Now, some of my own information:
I am so excited someone actually enjoyed the song. Now, did you actually listen to it all the way through, Talisman? :D

If ya can't tell, this entire role play kind of sprang from my love of Puscifer and Maynard James Keenan. Maynard is also the front man of Tool and A Perfect Circle. However, Puscifer has been up and coming since its formation...and the best part is, it's all been independent and works of collaboration through multiple artists (although I think Maynard did most, if not all, of Conditions of My Parole). I recommend that everyone listens to both of Puscifer's main albums, V is for Vagina and Conditions of My Parole...but I'd focus on COMP to get a feel of the amazingness of Puscifer's capabilities.

You should also watch Blood Into Wine, Maynard's documentary about his vineyard collaboration with Merkin's vineyard. That's where I got most of my inspiration from because it's set in Jerome. It's available on Netflix! :D

Now that I'm done promoting my most favorite artist, keep the submissions coming.

Another note...I don't understand why so many on this site are so adamant about PG-13 gore or violence or language. I don't give a fuck. :3

Alec Baldwin "lost appetite" to be NYC mayor (Reuters)

LOS ANGELES (Reuters) ? Actor Alec Baldwin said in his weekly New York radio podcast that he no longer has the appetite to run for New York City mayor, criticizing current candidates and expressing doubts the job was powerful enough to cause change.

"I've lost my appetite," Baldwin, 53, said during his interview with "Extremely Loud and Incredibly Close" director Stephen Daldry on his WNYC radio podcast, "Here's The Thing."

"The people that are running for mayor, I know this is terrible, I look at them and I don't see myself in that crowd," said the actor.

A possible foray into politics by the "30 Rock" actor has often been speculated upon in the media, with the actor himself saying he was "very, very interested" in the politics "game" in an interview with CNN earlier this year.

On his podcast, Baldwin and Daldry, a Londoner, were discussing the politics of their respective cities with Baldwin casting doubt on a potential political career by saying "The older I get, the more I feel that all of it has changed."

The actor added that he didn't want to give up his "wonderful life" for the chance to change society when he's not sure if a New York City mayor could still make an impact.

"30 Rock" star Baldwin, who recently made headlines after being asked to leave an American Airlines flight for playing a game on his smartphone before takeoff, also joked about the incident in the interview, saying "Some days, some flights are different than others."

Facebook agrees to changes for those in Europe

Facebook has agreed to make several changes to its services to improve transparency and better protect the personal data of its millions of users outside of the U.S., following an in-depth audit of its international headquarters that was released Wednesday.

The social media company, based in Palo Alto, California, agreed to changes including asking European users if they wanted to partake in its Facial Recognition, reworking its policies of retaining and deleting private data, and reducing the amount of information collected about people who are not logged into Facebook, the company said in response to the report of the Irish Data Protection Commissioner.

Facebook's international headquarters are based in Dublin, Ireland, a member of the European Union. This means the company is required to comply with European data privacy laws, which are more stringent than those that apply in the United States, particularly regarding how long data can be retained.

"Facebook has committed to either implement, or to consider, other 'best practice' improvements recommended by the data protection commissioner," the company said following the announcement of the report. "Meeting these commitments will require intense work over the next six months."

The company has agreed to present its results in a follow-up to the report in July.

Facebook has been scrutinized for its privacy practices in the U.S., too. In November, the company agreed to submit to government audits of its privacy practices every other year for the next two decades as part of a settlement with the Federal Trade Commission. The FTC's complaint had alleged that the company exposed details about users' lives without getting their consent, as legally required.

It is standard for Ireland's data protection commissioner to audit any high-tech companies in the country to ensure that their practices are in keeping with the European law, and make recommendations to help them to meet those standards, should they fall short.

"It is not the object of the audit, to decide whether there is a breach of law," Billy Hawkes, the data protection commissioner, told reporters. "It is to help an organization achieve full compliance with law, put their compliance into best practice.

Facebook has repeatedly come under fire in Europe for a raft of complaints ranging from accusations that it sells personal data to advertisers ? a charge that the Irish authority said its findings did not uphold ? its Friend Finder application and "archiving" of data that users have deleted.

This is especially the case in German-speaking nations, where laws protecting individual privacy and the use of personal information are even more far-reaching than those covering the European Union, where Facebook has run up against several complaints from local data protection authorities.

A group of Austrian students calling themselves Europe vs. Facebook also took up the crusade, filing a series of 22 complaints directly with the Irish authorities in what they said was an attempt to force Facebook to follow the rule of the law.

"We are thrilled," said Max Schrems, 24, who speaks for the group. "It is far more than what has previously been achieved in Europe. There are a lot of things that they have to change, far more than what they have had to change before."

How Smartphones Are Changing Photography: The Numbers Are In

Although global smartphone adoption is still just below 30 percent, smartphone photography is growing in popularity, disrupting traditional camera use. NPD made this trend clear in its Imaging Confluence Study, which found that smartphones accounted for 27 percent of photos shot this year.

Casey Anthony sued for defamation

The man who found 2-year-old Caylee Anthony's body in 2008 is suing her mother for damages, saying Casey Anthony defamed him during her murder trial earlier this year.

Former meter reader Roy Kronk said in a lawsuit filed in Florida on Wednesday that 25-year-old Anthony and her lawyers tried to shift suspicion away from the young mother and on to him.

Kronk testified he found Caylee's body in the woods near Anthony's home and called police. Casey Anthony was charged with killing her daughter, but a jury acquitted her in July.

In the suit, Kronk claims the defense variously accused him of involvement in Caylee's death. He said lawyers described him as a killer, a child snatcher and morally bankrupt, and accused him of finding and keeping Caylee's body and then placing the remains where they were found.

But defense attorney Jose Baez also told jurors Caylee accidentally drowned in the family's backyard pool. If that was true, then Anthony and her lawyers knew their statements about Kronk were false, according to his complaint.

Kronk also has sued the National Enquirer tabloid newspaper and bounty hunter Leonard Padilla for defamation.

In a motion to dismiss, the Enquirer claims its article accurately reported Anthony's attempt to blame Kronk and was based on documents filed in court records by her lawyers.

Padilla, who once bailed Anthony out of jail prior to her trial, contends in court records that anything he said about Kronk was opinion and related to a matter of public concern.

Kronk's suit against Anthony is the third she faces in Florida.

She is being sued for defamation by a woman named Zenaida Gonzalez, who claims her life was ruined when Anthony initially told investigators Caylee was kidnapped by a nanny of the same name.

Anthony also is being sued for damages by Texas EquuSearch, a nonprofit group, for expenses incurred during the five-month search for Caylee.

Also on Wednesday, a lawyer for Anthony filed a motion asking that a prosecutor be held in contempt of court for revealing details of her psychiatric evaluations in his new book about the case.

Jeff Ashton, who retired after Anthony's trial, published details from the depositions of two psychiatrists in his book, "Imperfect Justice." The doctors said Anthony claimed she had been molested by her father and her father had drowned Caylee.

Judge Belvin Perry sealed the depositions from public view before the trial began because the allegations were so sensational, according to Ashton, and Anthony's lawyers never called the psychiatrists as witnesses at trial.

Ashton could not be reached for comment on Thursday.

German businesses, consumers upbeat despite crisis

(AP) ? German business and consumer confidence ended 2011 on a high note despite ongoing fears about the European economy, two closely watched surveys showed Tuesday.

The Ifo Institute's monthly index of business confidence increased to 107.2 points from 106.6, as participants' assessment of their current situation remained unchanged but expectations for the next six months rose.

"Overall, latest Ifo data give ground for optimism that the German economy will weather the ongoing negative influence from eurozone debt crisis developments and the general worsening of prospects for external demand from the rest of Europe fairly well," said Timo Klein, an economist with IHS Global Insight.

Economists had been predicting a drop to 106 amid weakness in the global economy and serious concerns about the financial future of several eurozone countries.

"The German economy seems to be successfully countering the downturn in Western Europe," said Ifo president Hans-Werner Sinn. "This bodes well for Christmas."

Consumer confidence also proved resilient, according to the GfK research institute's forward-looking indicator for January. It remained unchanged from December's 5.6 points as people were optimistic "despite rising economic risks and further escalation of the debt crisis."

There were mixed messages from the survey, however, as German income and economic expectations both rose but consumers' willingness to buy dropped significantly, GfK said.

"Willingness to buy did not benefit from the improvement in economic and income expectations..." Gfk said, noting that it still remained at a "comparatively high level."

GfK said its survey of 2,000 consumers was almost complete before the most recent EU summit in Brussels and that it is unclear whether the inclination to hold back on purchases may now be resolved with the broad agreement reached there.

But it also said that while economic expectations are "defying the rising fears of recession," that might change as the debt crisis hurts German exports.

"With most German companies operating at above average capacity, the labor market is very robust and unemployment figures continue to fall," GfK said. "Whether this trend can be sustained remains to be seen ? the European debt crisis is increasingly likely to become a problem for Germany's export economy."

Dutch consumer confidence, by contrast, fell sharply in December to below the deepest lows of 2008 and 2009, according to a new report Tuesday.

The differing outlook is unusual, given the two economies' close trade links and common view on economic policy, as the Dutch government has consistently backed German policies throughout the crisis.

The country's Central Bureau for Statistics pointed to worries over the Dutch housing market, wage stagnation, and forecasts for a mild recession in the Netherlands in 2012 as key differences.

Ifo, which surveyed approximately 7,000 German businesses, said that their assessment of their current situation remained unchanged for the third month in a row, while expectations for the next six months ticked up for the third month in a row.

Earlier this month, Ifo lowered its forecast for German growth for 2012 to 0.4 percent because of the financial turmoil and a cooling global economy.

The government's independent economic advisers last month predicted that output would expand by 0.9 percent in 2012. Both forecast growth of 3 percent this year.

Another German think tank, the IfW institute, on Tuesday lowered its 2012 growth projection from 0.8 percent to 0.5 percent, while Essen's RWI institute lowered its forecast from 1 percent to 0.6 percent.

Carsten Brzeski, an economist with ING Global Research said that while it is clear that the German economy is cooling, the Ifo results indicate it is "heading towards a soft patch but not falling off the cliff."

"The length of the soft patch will to a large extent be determined by the management of the debt crisis," he said. "The German economy should remain the stronghold of the Eurozone. It is faltering, but not falling."

Time short for S&P to end 2011 higher (Reuters)

NEW YORK (Reuters) ? With two weeks left in the trading year, the euro-zone debt crisis will remain the primary impediment to pushing the S&P 500 index into positive territory for 2011.

Uncertainty over progress in the region, along with the potential for credit rating downgrades on euro-zone countries, have kept investors on edge and market volatility high.

Even with a fairly busy U.S. economic calendar, which includes a batch of data on the housing market, the final reading on gross domestic product and durable goods orders, markets will focus on developments from Europe.

"What everybody is going to look at is the same thing they've been looking at -- every time a German official opens their mouth, we get crushed," said Paul Mendelsohn, chief investment strategist at Windham Financial Services in Charlotte, Vermont.

"I'm keeping my fingers crossed that Santa Claus is out there. But we've got to see something."

The benchmark S&P 500 index (.SPX)(.INX) is down about 3 percent for the year and would need to climb above 1,257.64 in order to end higher for the year.

A stocks' rally on Friday fizzled, and the market ended with only modest gains after the latest credit warning about possible downgrades of European nations. For last week, the Dow fell 2.7 percent, the S&P 500 lost 2.9 percent and the Nasdaq slid 3.5 percent.

Italy's prime minister urged European policymakers on Friday to beware of dividing the continent in the effort to contain the debt crisis, warning against a "short-term hunger for rigor" in some countries, in a swipe at Germany.

Stocks have been whipsawed as investors weigh the threat from the euro-zone crisis against modest improvement in U.S. economic data and stocks that many regard as cheap.

"There do appear to be some improving economic indicators domestically, but it's hard to see how they win the day if Europe continues to be a big concern. It's not like the valuations are at such bargain-basement prices that it becomes a one-way bet," said Stephen Massocca, managing director at Wedbush Morgan in San Francisco.

As volumes begin to dry up and market moves become more exaggerated during the holiday period, the volatility may help lift the stock market into the plus column.

CHANCE OF RALLY

"Can you see an upside rally? Certainly, because you are going to have some asset managers in the end who are going to try and just push it so the market ends at the very least flat on the year, if not higher," said Ken Polcari, managing director at ICAP Equities in New York.

"If there is going to be a rally at all, it will happen on light volume because there will be fewer and fewer participants. When there is less volume, you do have the ability to have those exaggerated moves, but people will take advantage of that."

Volatility in individual shares could also be affected by corporate earnings pre-announcements. There have been 97 negative earnings pre-announcements issued by S&P 500 corporations for the fourth quarter, compared with 26 positive pre-announcements, resulting in a negative-to-positive ratio of 3.7. That's the highest in 10 years, according to Thomson Reuters data.

Companies that have provided outlooks in recent weeks include DuPont (DD.N), Intel Corp (INTC.O), United Technologies Corp (UTX.N) and Texas Instruments Inc (TXN.N).

Unexpected management shakeups could also be on the horizon and increase the tumult in stocks. Both Cablevision Systems Corp (CVC.N) and The New York Times Co (NYT.N) saw high-level executives suddenly leave their posts.

But stock movements this week will ultimately be dictated by actions taken in Europe, with the light volume exacerbating market swings.

"The only thing that is going to be of any interest is certainly the continuing headlines on Europe, whether or not they come any closer to what looks like a potential agreement," said Polcari.

"You may get a little bit of a push to the 1,250 to 1,270 range, but much beyond that I don't see why it would go any higher unless you get some explosive announcement out of Europe."

ZTE Score (Cricket Wireless)

The ZTE Score ($69.99 direct) is a low-cost, low-end Android smartphone?for Cricket Wireless that supports Cricket's Muve Music plan.

The Score is powered by a 600MHz Qualcomm MSM7627 processor and is running Android 2.3.4 (Gingerbread). It comes with 110MB of free internal memory, along with a 4GB microSD card that can be expanded to 32GB. There's a 3.2-megapixel camera that can record QVGA video.

The phone measure 4.4 by 2.5 by 0.5 inches and weighs 4.5 ounces. The biggest story here is the support for?Muve Music, which is an affordable, unlimited mobile music plan. It includes millions of tracks from Universal Music Group, Warner Music Group, Sony Music, and EMI. We found it to be a bit buggy, but promising.

The Score runs on Cricket's 3G network, which works on the 850-, 1,900-, and 1,700-MHz bands, depending upon your location. Coverage is somewhat limited, so make sure to check the maps at?www.mycricket.com before buying in.

While the ZTE Score is only an average smartphone, it's worth a look for music lovers that are interested in Muve.

Stocks climb after upbeat economic news

By msnbc.com news services

U.S. stocks closed higher Thursday as signs of strength in the economy and higher-than-expected profit at FedEx outweighed a stark warning from the IMF about inaction over Europe's debt crisis.

Trading was volatile before Friday's quadruple witching expiration when not only equity options expire, but also stock index futures, stock index options and individual stock futures.

Stocks pared some of their gains after Christine Lagarde, the head of the International Monetary Fund, said the world economic outlook is "quite gloomy" and will require action by all countries to head off an escalating crisis that carries risks of a global depression.

But investors were cheered by the latest data that suggested the U.S. economy was showing modest growth.

Applications for unemployment insurance fell to a 3-1/2 year low, while a gauge of New York state manufacturing activity rose to its highest level since May and a separate measure of factory activity in the mid-Atlantic region showed a surge in new orders.

The market's gains were concentrated in defensive sectors such as utilities, suggesting uncertainty was causing risk-takers to put their portfolios in neutral as the week draws to an end, said Chad Morganlander, portfolio manager at Stifel, Nicolaus & Co in Florham Park, New Jersey.

"Unfortunately austerity without a plan for structural changes will cap economic growth and potentially could bleed into earnings. Going into the new year, portfolio managers are squaring their books for that scenario," Morganlander said. "There's a continued rotation into safety and stability in a global austerity environment."

FedEx Corp shares shot up after the package delivery company, seen as a bellwether of economic activity, reported stronger-than-expected quarterly profit.

The news from FedEx was welcome after a number of high-profile companies warned about revenues and profits in recent days. On Thursday, Honeywell International said Europe's slowing economy would take a toll on orders. But Honeywell's stock rose after it forecast profit in line with expectations.

On Wednesday, Wall Street fell for a third day to its lowest level in two weeks with the market highly sensitive to developments in Europe.

Big-cap technology shares slipped, including shares of Apple and International Business machines. Novellus Systems Inc jumped one?day after it agreed to be bought by larger rival Lam Research Corp for $3.3 billion in stock.

Michael Kors Holdings Ltd shares jumped in their debut on the New York Stock Exchange after the luxury goods company went public at $20 per share on Wednesday, above the expected range. Earlier Thursday, the stock climbed as much as 25 percent.

Comet defies death, brushes up to sun and lives (AP)

WASHINGTON ? A small comet survived what astronomers figured would be a sure death when it danced uncomfortably close to the broiling sun.

Comet Lovejoy, which was only discovered a couple of weeks ago, was supposed to melt Thursday night when it came close to where temperatures hit several million degrees. Astronomers had tracked 2,000 other sun-grazing comets make the same suicidal trip. None had ever survived.

But astronomers watching live with NASA telescopes first saw the sun's corona wiggle as Lovejoy went close to the sun. They were then shocked when a bright spot emerged on the sun's other side. Lovejoy lived.

"I was delighted when I saw it go into the sun and I was astounded when I saw something re-emerge," said U.S. Navy solar researcher Karl Battams.

Lovejoy didn't exactly come out of its hellish adventure unscathed. Only 10 percent of the comet ? which was probably millions of tons ? survived the encounter, said W. Dean Pesnell, project scientist for NASA's Solar Dynamics Observatory, which tracked Lovejoy's death-defying plunge.

And the comet lost something pretty important: its tail.

"It looks like the tail broke off and is stuck" in the sun's magnetic field, Pesnell said.

Comets circle the sun and sometimes get too close. Lovejoy came within 75,000 miles of the sun's surface, Battams said. For a small object often described as a dirty snowball comprised of ice and dust, that brush with the sun should have been fatal.

Astronomers say it probably didn't melt completely because the comet was larger than they thought.

The frozen comet was evaporating as it made the trip toward the sun, "just like you're sweating on a hot day," Pesnell said.

"It's like an ice cube going by a barbecue grill," he said.

Pesnell said the comet, although only discovered at the end of November by an Australian observer, probably is related to a comet that came by Earth on the way to the sun in 1106.

As Comet Lovejoy makes its big circle through the solar system, it will be another 800 or 900 years before it nears the sun again, astronomers say.

BP settles with maker of failed blowout preventer (AP)

NEW ORLEANS ? Cameron International, the maker of the Deepwater Horizon blowout preventer that failed to stop last year's massive oil spill in the Gulf of Mexico, has agreed to pay $250 million to BP under a legal settlement, BP said Friday.

BP said it was "in their mutual best interests, and the agreement is not an admission of liability by either party." The companies are dropping all claims against one another, they said.

The settlement comes in advance of a federal trial over the catastrophic Gulf oil spill. The non-jury trial is slated to begin in February and determine fault in the April 20, 2010, explosion and subsequent oil spill off the Louisiana coast of more than 200 million gallons of oil.

The settlement with Cameron does not end the legal fighting over the blowout of the Macondo well, which was owned by London-based BP and two partners, MOEX and Anadarko. BP has already settled claims with those two companies and a third company, Weatherford, the maker of a part used in the well.

"Today's settlement allows BP and Cameron to put our legal issues behind us and move forward to improve safety in the drilling industry," said Bob Dudley, BP group chief executive.

"Unfortunately, other companies persist in refusing to accept responsibility for their roles in the accident and for contributing to restoration efforts," Dudley said in a swipe at Halliburton Corp. and Transocean Ltd. Halliburton supplied critical cement to seal the well and Transocean was the company drilling the well.

Probes of the Deepwater Horizon explosion by the federal government and independent scientists and engineers have found all three companies were at fault for a series of decisions and actions that led to the Macondo well blowout, the nation's largest offshore oil spill.

BP is engaged in an intense legal fight with Halliburton Corp. and Transocean. Earlier this month, BP went so far as to accuse Halliburton employees of covering up damaging evidence about a cement mixture Halliburton used in drilling the well.

BP said it would use the $250 million from Cameron to pay for the cost of cleaning up from the spill and paying individual damages claims by people, businesses and government entities hurt by the spill. BP said it has spent about $7.5 billion so far of those claims. But the British company faces billions of dollars in additional damages and fines.

Under the agreement, BP said Houston-based Cameron is no longer responsible for any additional cleanup costs related to the spill. But BP said the agreement does not cover civil, criminal and administrative fines and other penalties that might arise out of the court proceedings.

Jack Moore, the chairman and CEO Cameron, said the agreement with BP "removes uncertainty facing Cameron" as litigation intensifies over the Deepwater Horizon explosion.

"This eliminates all significant exposure to historical and future claims related to this incident," Moore said.

Moore said Cameron does not expect to have to pay much for possible court fines and penalties. "We do not consider these items to represent a significant risk to Cameron," he said.

Cameron said its insurers were expected to fund at least $170 million of the $250 million payment the company agreed to make to BP.

BP and Cameron also pledged to "improve safety in the drilling industry" and do more to improve blowout preventers.
