L.A. mayor: 'Carmageddon II' turns into 'Carmaheaven'

LOS ANGELES (AP) ? Mayor Antonio Villaraigosa on Sunday called "Carmageddon II," the sequel to last year's shutdown of one of the nation's busiest freeways, a success and thanked drivers for staying off the road and keeping the weekend traffic unusually light.

Bridgework that forced the closure of Interstate 405 was completed and lanes of the freeway through the Sepulveda Pass will reopen as planned for the Monday morning commute, Villaraigosa told a news conference.

"We are on track," he said.

A similar closure occurred last year to demolish portions of the Mulholland Drive bridge to allow construction of an additional freeway lane. Like last year, city residents heeded months of warnings to stay off the road and the fear of an epic traffic jam never materialized.

Villaraigosa says his hope for a "Carmaheaven" came true and thanked drivers for their cooperation.

"The real stars of this sequel were the motorists who took advantage of a car-free weekend and stayed off the road," he said.

Like Villaraigosa, some drivers couldn't resist comparing the scenario to a movie.

"It's like that movie 'Vanilla Sky,' ... where Times Square is empty," Sterling Gates told KABC-TV. "It's kind of like that. We're known for our traffic, and it's just nothing."

The closed, 10-mile section of the 405 carries about 500,000 motorists each day on a typical weekend, according to the Los Angeles Times. California Department of Transportation officials said that in order for "Carmageddon II" to be a success, at least two-thirds of those drivers need to stay off the road.

The rare sight of a carless freeway attracted many onlookers, including seven people who were cited for sneaking onto the roadway, the California Highway Patrol said.

Last year, three people slipped onto the freeway at the crack of dawn and snapped photos of themselves enjoying a gourmet meal on an eerily empty freeway.

Gay couples may get reprieve in deportation cases

SAN FRANCISCO (AP) ? The Department of Homeland Security is planning to issue a policy memo stating that illegal immigrants with American same-sex partners are eligible to have their deportations put on hold under a federal program designed to focus resources away from low-priority cases.

The move had been sought by gay rights activists and their allies in Congress before Homeland Security Secretary Janet Napolitano announced plans for the policy Thursday in a letter to 84 Democratic lawmakers.

"It will mark the very first time that lesbian and gay couples have been recognized within immigration policy for relief," said Steve Ralls, the spokesman for Immigration Equality, an advocacy group for gay, lesbian, bisexual and transgender immigrants.

The Democratic lawmakers addressed in Napolitano's letter pressed the agency to inform Immigration and Customs Enforcement field offices that bi-national gay couples in long-term relationships have family ties that should be considered as grounds for deferring a foreign citizen's removal from the U.S.

"I have directed ICE to disseminate written guidance to the field that the interpretation of the phrase 'family relationships' includes long-term, same-sex partners," Napolitano wrote, adding that the decision to grant reprieves still would be considered on a case-by-case basis.

The instructions do not mean that foreigners who are married to Americans of the same sex will be eligible for green cards or citizenship, as are immigrants with opposite sex spouses. The Obama administration is continuing to enforce a 1996 law that prohibits the government from recognizing same-sex marriages, even as it opposes it in court and takes gay relationships into account when evaluating deportation cases.

The Williams Institute, a think tank, estimates that as of 2010 there were about 29,000 same-sex couples nationwide comprised of a U.S citizen and a citizen of another country.

Mark Krikorian, executive director of the Center for Immigration Studies, a Washington group that advocates tighter immigration policies, said that even though the administration says it is complying with the 1996 Defense of Marriage Act by not allowing citizens to sponsor same-sex spouses for green cards, the pending guidance for ICE officials to review the family ties of same-sex couples suggests otherwise.

"It's a camel's nose under the tent," Krikorian said. "If you get same-sex couples approved in terms of immigration, you can use that as an incremental approach to getting changes in other areas, such as in tax policy."

The policy guidance expected to go out next week will reference a memo ICE Director John Morton issued last year advising the agency's officers and lawyers to review pending deportation cases to determine which ones should be top priority and which ones might be shelved, Napolitano said.

Government attorneys weigh factors such as a person's criminal record, family ties and community relations in making their decisions.

ICE officials said at the time that long-term same-sex relationships could be included under the family ties criteria, but advocates and House Democrats led by Minority Leader Nancy Pelosi wanted that determination put into writing.

O2 UK to sell upcoming HTC flagship phone without charger

If you're anything like us, you'll have plenty of wall chargers left over from devices you've long since parted company with. Observe above, the mangled husk of our two and a half year-old HTC Desire charger, still in service today. Knowing that many older chargers are still in use, O2 UK and HTC have decided to take a radical step to cut down on waste, and presumably save a bit of cash at the same time. O2 claims that 70 percent of all phone buyers already have a "relevant charger" at home.

The two are to offer an upcoming, unnamed HTC flagship device with a microUSB cable, but no charger, in an effort to improve their green credentials. And according to a report on UK tech site Pocket-Lint this morning, O2 and HTC are serious about this latest endeavor.

"I have a simple vision for O2: we want to take chargers out of boxes full stop," said Ronan Dunne, CEO of O2. "Right now, O2 with HTC has to go it alone on this matter - we both believe in it passionately enough that we can’t wait for the industry as a whole to join us in this crusade. That said, we hope that we will be able to pave the way for others to follow us as this has to be a collective effort if we are to achieve the bigger aim of eliminating chargers sold with every new phone in the UK."

We're all for cutting down on unnecessary waste, but from our perspective, the most interesting thing about this story is that it tacitly confirms that we're due a new HTC flagship in the weeks ahead, and that O2 will offer it. The fact that the device itself is unnamed suggests it's yet to be announced -- possibilities include the rumored One X+ and One X 5. We'll be watching with interest to see what devices emerge from HTC and O2 as 2012 draws to a close.

Health care law will be implemented, most say in poll | NOLA.com

It still divides us, but most Americans think President Barack Obama's health care law is here to stay. More than 7 in 10 say the law will fully go into effect with some changes, ranging from minor to major alterations, a new Associated Press-GfK poll finds. Only 12 percent expect the Affordable Care Act ? "Obamacare" to dismissive opponents ? to be repealed completely.

The law ? covering 30 million uninsured, requiring virtually every legal U.S. resident to carry health insurance and forbidding insurers from turning away the sick ? remains as contentious as the day it passed more than two years ago. There's still more than another year before its major provisions go into effect on Jan. 1, 2014.

Although the overhaul survived a Supreme Court challenge in June, the November election appears likely to settle its fate. Republican Mitt Romney vows to begin repealing it on Day One while Obama pledges to carry it out faithfully.

But the poll found that Americans are converging on the idea that the overhaul will be part of their lives, although probably not down to its last comma. They don't totally buy what either candidate is saying.

"People are sort of averaging out the candidates' positions," said Harvard School of Public Health professor Robert Blendon, who tracks polling on health care issues.

Forty-one percent said they expect the law to be fully implemented with minor changes, while 31 percent said they expect to see it take effect with major changes. Only 11 percent said they think it will be implemented as passed.

Americans also prefer that states have a strong say in carrying out the overhaul.

Sixty-three percent want states to run new health insurance markets called "exchanges." Open for business in 2014, exchanges would sign up individuals and small businesses for taxpayer-subsidized private coverage. With GOP governors still on the sidelines, the federal government may wind up operating the exchanges in half or more of the states, an outcome only 32 percent of Americans want to see, according to the poll.

Developed with researchers from Stanford University and the University of Michigan, the poll also found an enduring generation gap, with people 65 and older most likely to oppose the bill and those younger than 45 less likely to be against it.

Republicans remain overwhelmingly opposed to the overhaul and in favor of repeal. But only 21 percent said they think that will actually come about.

Romney supporter Toni Gardner, 69, a retired school system nurse from Louisville, Ky., said that until a few weeks ago she was sure her candidate fully supported repeal, as she does.

But then Romney said in an interview there are a number of things he likes in the law that he would put into practice, including making sure that people with pre-existing medical problems can get coverage. The Romney campaign quickly qualified that, but the candidate's statement still resonates.

"If Romney gets in, he'll go with parts of it," Gardner said, "and there are parts of that he won't go with."

Gardner thinks expanding coverage will cost too much and may make it harder to get an appointment with a doctor. Besides, she doesn't believe the government can handle the job. She's covered by Medicare ? a government-run health system ? but says "that wasn't a choice that I had."

At 26, Santa Monica, Calif., web developer Vyki Englert has only bare-bones health insurance coverage. Her parents, a preschool teacher and a self-employed photographer, are uninsured. Englert says she thinks the law will largely go into effect as passed. (Among 18- to 29-year-olds, 60 percent think it will be implemented with only minor changes or none at all.)

Englert says that she supports guaranteeing coverage to people with health problems and that provisions such as broader coverage for birth control will help younger women such as her.

"I kind of see a day-to-day way where this law could benefit me," she said. Englert says the health care law dovetails with a trend toward consumerism in her generation. Older Americans "don't have the context of the young people," she added. "They are looking more at the theoretical impact on the budget and the country."

Overall, the poll found Americans divided on repeal, with neither side able to claim a majority. Forty-nine percent said the health care law should be repealed completely, while 44 percent said it should be implemented as written.

The notion that the law will be implemented with changes, captured in the poll, mirrors a discussion behind the scenes in Washington, particularly among some Republicans.

"Whoever wins the election, the (health care law) is going to be modified," Mark McClellan, who ran Medicare under former President George W. Bush, said in a recent interview.

Congressional Republicans say if tax increases are on the table in budget negotiations with a re-elected Obama, changes to the health care law or delays in implementation are also fair game.

Some parts of the law already are in effect; its big push to cover the uninsured doesn't come until 2014.

Public opinion about the law itself has barely budged since 2010, soon after it passed. At the time, 30 percent supported it. That's now 32 percent. And 40 percent opposed the overhaul. That's now 36 percent.

Misconceptions about the law that reigned two years ago live on, including former Alaska Gov. Sarah Palin's widely debunked charge that it would create "death panels" to decide on care for the elderly and disabled. In 2010, 39 percent believed the law would set up committees to review individual medical records and decide who gets care paid for by the government. Forty-one percent still hold that view, according to the poll.

The poll asked people to say whether 18 different items were in the law or not and to rate how certain they were about their answers. Just 14 percent were right most of the time and sure of it.

Still, knowledge about what the law actually does is growing. More people are aware of provisions that allow adult children to stay on their parents' coverage until age 26, impose insurance mandates on individuals and businesses, and protect those with pre-existing medical conditions.

The poll was conducted Aug. 3-13 and involved interviews with 1,334 randomly chosen adults nationwide. It has a margin of sampling error of plus or minus 3.4 percentage points.

The survey was conducted online by GfK using its KnowledgePanel sample, which first chose people for the study using randomly generated telephone numbers and home addresses. Once people were selected to participate, they were interviewed online. Participants without Internet access were provided it for free.

Getting on Track is an 8-week weight loss program that focuses on lifestyle
changes needed to help you find a lifelong healthy weight.? Simply put, we work
with you to help decrease the typical frustration, confusion and deprivation
that often occur with most weight loss attempts.? This is created to fit your
real world, with all of its challenges and time constraints ? that is the
basis of this program.?

You will participate in seven, interactive classes taught by a dietitian, exercise physiologist and licensed counselor/life coach. Each class includes a healthy dinner. Additionally, each participant is given individual prescriptions for their nutritional needs and exercise intensity needs based off of your specific requirements. The eighth session is a group meeting where the skills and knowledge you acquired are applied and discussed.

After completing the program, you may continue to participate in the group
support sessions with Staying on Track? to further understand your personal
journey.

The program meets on Thursday nights from 6:15-8:00pm and our next
session starts September 20th.?

Participants can also exercise in our gym and touch base with our staff on those Thursday nights prior to class (5:15-6:15pm).

An Appeal for Autonomy: Sex and Dementia in Aged Care Facilities ...

Residential aged-care facilities (RACFs), which promote a balance between providing care and retaining autonomy, are often thought to be the best option for the elderly who can no longer live alone.

However, a 2012 study led by Dr. Laura Tarzia and published in the Journal of Medical Ethics has revealed that these services frequently come at the price of sexual expression. The study found that many RACF residents, specifically those with a form of dementia, were denied sexual relationships, which are considered by many to be a basic human right.

Although RACFs advertise an independent lifestyle, most lack sufficient privacy for sexual expression. If an opportunity for intimacy is indeed found, the privacy can be short-lived. Staff members are typically required to report any knowledge of a relationship. This is done so that management can be aware and the situation can be discussed with the families of the residents.

Such discussions often disregard the wishes of the resident. In these cases of resident sexuality, RACF management?s duty to appease the residents? families often outweighs their duty to the residents? independence.

The predominant attitude of the care and management staff at many RACFs may be a leading cause for the resistance toward sexuality. Elderly residents are often treated patronizingly by care workers, who see them as sexless or childlike. This mind-set, typical among members of the general public as well, is reflected in the term ?ageism,? defined as the negative view of aging people, a view that is common in Western societies. Researchers Jocelyn Angus and Patricia Reeve note that ageism stems from cultural values including a fear of death, productivity-based societal worth and the association of youth with sexuality.

While ageism is a problem faced by many RACF residents who wish to be sexually active, it can become further complicated when those residents have dementia. Residents with compromised mental status undoubtedly risk exploitation. Therefore, when seeking to promote a safe environment for sexual expression in RACFs, staff members must clearly differentiate sexual abuse from consensual relationships between residents. For care providers, though, appropriately balancing nonmaleficence and autonomy can cause anxiety about the boundaries of their duty of care.? Because care providers often lack training and support when it comes to finding this middle ground, nonmaleficence tends to win out over autonomy to guard the residents from risk.

However, even when done with the best of intentions, it is unfair to generalize about all residents with dementia in this way. Dr. Tarzia writes, ?Seeking to ?protect? individuals with dementia by not allowing them to express their sexual needs, thereby stifling their autonomy and personhood, is a far greater failure of duty of care.? What is really needed is a modern and accurate way to assess the risks involved.

More than 50 percent of people in RACFs have some form of dementia, but laws regarding consent don?t generally address people with dementia. Without specific guidelines, most RACFs favor a paternalistic, conservative approach to avoid criticism. Some demented residents have been deemed unfit to make high-stakes decisions related to finances or medical treatment, but the tests used for this are unsuitable for determining sexual-consent abilities. In these situations, a person-based, case-by-case plan needs to be developed to evaluate capacity for consent. Otherwise, the challenge will continue to be avoided by deferring judgment to people who are evaluating scores from inappropriate tests.

A person-based approach could be valuable in preserving autonomy for residents and improving their quality of life. Findings have indicated that maintaining meaningful contact and compassion can counter the negative health effects of loneliness in old age. As physical intimacy can be part of building and sustaining a strong bond in a relationship, allowing it when appropriate is in the best interests of all because it will help keep residents healthy. This situational approach would also allow the potential for abuse to be thoughtfully addressed without needlessly putting restrictions on safe, consensual relationships.

Dr. Tarzia summarized the team?s findings by saying, ?You have got to remember these people are adults, they?re not children and yes they do have a diagnosis of dementia but that doesn?t mean they can?t make decisions for themselves about a lot of things.? Clearly, efforts need to be made to reverse the prevalent paternalistic attitude toward the elderly and establish appropriate guidelines for consent by people with dementia. And until then, care providers need to ensure that ageism does not pervade RACFs and undermine the autonomy of capable, consenting residents.

Privatizing Israel's Legal System | Global Research

Israel?s Mandatory Arbitration Bill (MA) is troubling. Justice Minister Yaakov Neeman proposed it. It mandates compulsory arbitration for civil suits filed in Magistrate Courts.

The Court president or deputy may order it. Litigants have no say. Neeman claims it?s needed to reduce excessive case loads. His hidden agenda has other things in mind. Judicial fairness will be compromised if he prevails.

On September 4, Knesset members discussed it ahead of second and third readings. Strong opposition exists. More on that below.

Arbitration is an alternate form of dispute resolution. It?s common in commercial disagreements. Costly litigation is avoided. So are conventional court proceedings.

When voluntary, both sides agree to let an arbitrator or arbitral panel review evidence and impose binding rulings.

Mandatory arbitration is more controversial. It lets one party impose its will on another. In commercial disputes, companies have bargaining power at the expense of consumers. Litigation rights are denied. So are class actions. Unfair proceedings result. Outcomes may be predetermined.

Israel?s MA bill lets courts forward civil suits to private lawyers. They?ll become designated arbitrators. Litigants can?t sue.

The Association for Civil Rights in Israel (ACRI) said this measure ?has no equivalent anywhere in the world.? If enacted, Israeli judicial fairness will be severely compromised.

ACRI, Israeli Supreme Court President Asher Grunis, retired justices, and prominent jurists oppose the bill for good reason.

ACRI attorney Anne Suciu calls it step one toward privatizing Israel?s courts. Doing so will severely damage judicial fairness. Unlike judicial vetting, the main qualification for arbitrators is seven years seniority.

Another is the absence of frequent conflicts of interest between his or her proposed arbitral status and outside financial interests.

According to legislative language, individuals with some, but not too many, conflicts are eligible. Moreover, no limitation is placed on ones considered minor. No definition explains.

Growing criticism in some countries led to greater protection for weaker parties in arbitration disputes. Israel?s measure denies it. According to Suciu:

?Years of under-funding led to an unbearable burden on the court system. Instead of solving this problem by amending the system, many decision-makers blindly accept the view that privatization is the desired solution for almost every public service that is not properly functioning.?

?The Mandatory Arbitration Bill is an extreme initiative that has no equivalent anywhere in the world, and it could violate the basic right to a due process.?

Israel?s Basic Law states that ?person(s) vested with judicial power shall not, in judicial matters, be subject to any authority but that of the Law.?

Legal provisions are intended to ensure judicial independence. Qualifications for judges are strict. They include ethical standards, salaries, length of service, termination of service, and others. According to Israeli Supreme Court Judge Ayala Procaccia:

?We set the standards of behavior that apply to specific judges. They are subject to strict standards of conduct not only judgment, but also in other walks of life?.They have to understand that the judgment is not just a job. It is a way of life.?

Suciu believes that transferring civil jurisdiction authority to private parties reflects a ?simplistic and flawed judicial role of a specific solution to the conflict between? two parties.

Doing so ignores ?competent court of law interpretation,? longstanding social values, fundamental rights and obligations, and rule of law priorities.

Civil litigation is a right. It plays a key role in democratic societies. Privatizing the judiciary compromises freedom. Israel?s MA bill raises fundamental constitutional issues. It?s excessive and unreasonable. It damages the public?s trust in courts.

According to Supreme Court Judge Mishal Hashin, judicial access is ?an essential basic right.? It?s also ?the life blood of the court. (When) the path to the court is obstructed, whether directly or indirectly, or even partially, it undermined the raison d??tre of the judiciary.?

At the same time, legal procedures and laws aren?t absolute. Times change, and so do they. Doing so should strengthen democracy, not compromise it. Denying judicial access is dangerously unreasonable.

Privatizing judicial authority compromises basic rights. Mandatory arbitration undermines its intended purpose. Strict regulations, ethics standards, and a supervisory system govern judges.

The arbitrator selection process is lax by comparison. No restrictions are placed on political activity, private practice, income, or other activities potentially compromising their independence. Arbitrators can live double lives.

MA bill provisions include operating according to substantive law and evidentiary rules. However, arbitrators won?t be bound by judicial procedures and some Arbitration Law mandates.

Arbitrators will be able to make up his or her own rules and operate virtually ad hoc. Moreover, qualified jurists may be shut out. Only persons who?ve practiced law are eligible. Judges, law professors, and others with legal expertise won?t qualify without this credential.

In addition, the bill greatly empowers Israel?s justice minister. He alone may determine who?s qualified for appointment. Selection standards should be no different than for judges. No one person should have sole authority.

On September 5, the Jerusalem Post headlined ?Supreme Court President stops Neeman arbitration reform,? saying:

Israel?s High Court of Justice President Asher Grunis strongly opposes Israel?s MA bill. As a result, the Knesset Constitution, Law and Justice Committee asked Neeman to respond.

Grunis isn?t alone. Other bill opponents include Knesset members, the Israel Bar Association, senior jurists, ACRI, and other legal experts concerned about privatizing legal procedures.

Neeman?s history is checkered. Previous initiatives he supported empowered the executive and legislative branches at the expense of the judiciary. He?s no friend of judicial fairness and other democratic values.

MA bill critics call it poorly designed. It?s rife with provisions likely to compromise judicial independence, due process, judicial relief, and other constitutional protections.

Litigants also have no say. If ordered to arbitration, they?ll be shut out of conventional judicial proceedings. Labor MK Isaac Herzog accused Neeman of trying to pull off a ?revolution.? He also said he was undercutting Grunis? authority.

Overburdened court dockets don?t justify compromising judicial fairness. Instead of arbitrators, Israel?s Bar Association urged appointing temporary judges during overload periods.

Israel long ago headed down a slippery slope. Its democracy is seriously flawed. It?s more hypocrisy than real. Mandatory arbitration assures further weakening. Political reality can?t hide disturbing attempts to transform its deficiencies into strengths.

Arabs never had rights. Jewish ones are eroding en route to eliminating them altogether. Israel isn?t just a pariah state. It?s a failed one. It?s just a matter of time before concealing it becomes impossible.

Now we know why the skinflint rich hate Obamacare:

Most Americans pay more in payroll taxes ? which finance Social Security and Medicare ? than they do in income taxes. The rich are different.

Mitt and Ann Romney paid virtually no payroll taxes in 2011, because nearly all their income came from investments on which payroll tax was not owed.

For most taxpayers, the 2.9 percent Medicare tax levied on wage income will be the same next year as it was in 2011. But starting in 2013, high-income taxpayers will pay more ? and in the Romneys? case ? much more.

Married taxpayers with income over $250,000 will pay a 3.8 percent Medicare tax rate on income over that amount, and all income will be covered, including the capital gains that make up most of the Romneys? income.

If their 2013 income were unchanged from this year, their Medicare tax bill would exceed $500,000.

That tax was passed as part of the health care bill enacted by Congress and signed by President Obama in 2010 ? a law known as ?Obamacare.? Mr. Romney has pledged to seek repeal of that law.


Let's lift the cap on social security too,while we're at it. After all, if a man is so rich that he he can earn many millions while running for president --- so many millions that he was able to "over-contribute" as a PR stunt, then he can easily afford to put more money into the safety net. In fact, he won't even feel it.

Oh, and also. This seems to be a good time to clear up the confusion about Rafalca the dressage horse. Like may others, I erroneously said the other day that the Romney's got a $77,000 deduction for the horse. That's wrong. As this thorough Forbes piece spells out, they haven't actually gotten it yet. It's a deferred deduction. This deferral is very complicated. I don't think it will be something you'll find on Turbo Tax as an option to pay for your quilting hobby, but wealthy people like the Romney's have high paid tax lawyers to do that for them.

(AP) ? Records could be set and hearts definitely will be broken at the Emmy Awards.

Sunday's ceremony gives "Mad Men" a chance to snare its fifth best drama award, surpassing fellow record holders "Hill Street Blues," ''L.A. Law" and "The West Wing."

"Breaking Bad" and "Homeland" are among the series that could prove spoilers for AMC's sophisticated saga about 1960s America.

Bryan Cranston of "Breaking Bad" has a shot at his fourth best drama actor victory, which would tie Dennis Franz's record set in 1999 for "NYPD Blue."

If Cranston wins, that would leave "Mad Men" star Jon Hamm and Michael C. Hall of "Dexter" out in the cold for the fifth time.

Jimmy Kimmel is host of the ceremony airing live at 8 p.m. EDT on ABC, with awards in 26 categories to be presented at the Nokia Theatre.

There's no question broadcast networks will be squirming: Five out of six best drama series slots were claimed by cable shows, both premium and basic, with the sixth going to PBS' "Downton Abbey." On the comedy side, HBO's "Girls," ''Veep" and "Curb Your Enthusiasm" made big inroads.

For the elegantly soapy "Downton Abbey," the question is whether a switch from the miniseries category to drama series competition will spell doom for the chances of Maggie Smith, a winner last year, and other cast members including Michelle Dockery.

"Girls," HBO's tough, 21st-century spin on "Sex and the City," and its creator-star Lena Dunham could prove the evening's sweethearts. The show is up for four awards, including best comedy series.

Its heavyweight competition includes "Modern Family," which could claim its third consecutive best comedy series award.

In the miniseries and TV movie category, crowd-pleaser "Hatfields & McCoys" is up against competitors including "Sherlock: A Scandal in Belgravia" and "Game Change," a dramatization of the John McCain-Sarah Palin 2008 campaign.

But Emmys recognize TV's best, not most popular. While leading nominee "Mad Men" averaged just 2.6 million viewers last season, top-rated show "American Idol" (26 million-plus) isn't even in contention Sunday for best reality-competition program. At least host Ryan Seacrest is, but he faces the formidable Betty White ("Betty White's Off Their Rockers").

Talk show host Kimmel has the chance to burnish his reputation or do a painful David Letterman-style belly flop. He's riding a career wave after adroitly emceeing the White House Correspondents' Association dinner and with ABC's decision to move his late-night show into the thick of competition with Letterman and Jay Leno.

HBO came into the night with a leading 17 creative arts Emmys from a Sept. 15 ceremony honoring technical and other achievements. CBS was second with 13, followed by PBS with 11. Discovery received six awards, NBC got five and ABC and the Cartoon Network won four each. Fox received two trophies.

Emmy has to prove herself a winner with the audience. After rebounding somewhat to 13.5 million viewers in 2010 after an all-time low in 2008 of 12.3 million, last year's show drew 12.4 million viewers airing on Fox. The ceremony rotates annually among the four major networks.

Mauled N.Y. man: I wanted 'to be one with the tiger'

NEW YORK (AP) ? Before his now-infamous tangle with a Bronx Zoo tiger, David Villalobos adorned his Facebook page with New Age odes to Mother Earth and affirmations like, "Be love and fearless."

Police said Saturday that Villalobos had told detectives that it was without fear that he leaped from an elevated train into the animal's den. His reason, they said, was that "he wanted to be one with the tiger."

Villalobos also recounted how, after he landed on all fours, the 400-pound beast attacked him and dragged around by his foot, said New York Police Department spokesman Paul Browne. Despite serious injuries, he claimed he was able to get his wish and pet the tiger ? a male Siberian named Bashuta ? before his rescue, the spokesman added.

Based on those admissions and a complaint from the zoo, police were planning to arrest the hospitalized Villalobos on trespassing charges, Browne said. It was unclear when that would happen or if the 25-year-old real estate agent had an attorney; attempts to reach relatives on Saturday were unsuccessful.

Villalobos' big-cat exploits Friday afternoon were an instant tabloid sensation: A front page New York Post story on Saturday was headlined "MAULED!" The Daily News countered with "ZOO-ICIDE," speculating a death wish.

Police had said earlier that Villalobos admitted to a police officer at the scene that he made a conscious decision to jump ? "Everyone has a reason for what they do in life," he was quoted as saying ? but that his motives were murky and an arrest uncertain.

That changed when, during a follow-up interview Saturday, Villalobos told detectives that "his leap was definitely not a suicide attempt, but a desire to be one with the tiger," Browne said.

Villalobos remained hospitalized with bites and punctures on his arms, legs, shoulders and back, and a broken arm and a leg caused by the jump.

The Wild Asia exhibit that's home to the tiger was operating as usual on Saturday, zoo officials said, declining to comment further.

Villalobos' Facebook page makes clear his infatuation with wildlife. One of several postings from Thursday was a photo of a tiger licking a cub, and the comment, "Nice." Another was of a black jaguar.

An earlier post displayed a promo for a movie called "Facing Animals," a Dutch documentary about "the complex and often bizarre relationship between man and animal."

His comment: "This looks fascinating."

Villalobos' own bizarre encounter began with a ride on the elevated train that takes unrestrained visitors over the Bronx River and through a forest, where they glide along the top edge of a fence past elephants, deer and a tiger enclosure. He and a date had taken in the same sights from the monorail during a visit to the zoo about two weeks ago, police said Saturday.

This time without warning, Villalobos apparently jumped out of his train car and cleared the 16-foot-high perimeter fence. He was alone with Bashuta for about 10 minutes before he was rescued by zoo officials, who used a fire extinguisher to chase the animal away.

The zookeepers instructed him to roll under an electrified wire to get to safety, zoo director Jim Breheny said. They then called the tiger into a holding area.

The Bronx Zoo, one of the nation's largest zoos, sprawls over 265 acres and contains hundreds of animals, many in habitats meant to resemble natural settings. Its exhibits include Tiger Mountain, Congo Gorilla Forest and World of Reptiles.

There are 10 tigers at the Wild Asia exhibit, but the 11-year-old Bashuta was the only one on display at the time. Zoo officials said he would remain in the rotation.

"When someone is determined to do something harmful to themselves, it's very hard to stop that," said Breheny. "The tiger did nothing wrong."

Iraq has executed nearly 100 people so far this year, a big increase over previous years that has intensified concern about whether defendants are receiving fair trials in a country where the United States has spent billions of dollars trying to reform the judicial system after decades of dictatorship.

The government says most of the executed had been convicted of terrorism as bombings and shootings persist in Iraq, albeit not at the levels at the height of its conflict years ago. However, international observers worry that the legal process is faulty and that some trials are politically motivated ? including this month's death sentence against Iraq's fugitive Sunni vice president, Tariq al-Hashemi, a longtime foe of Shiite Prime Minister Nouri al-Maliki who was convicted in absentia of running death squads.

The executions in 2012 of at least 96 people, all by hanging, amount to more than a quarter of all convicts who have been put to death in the last eight tumultuous years under leaders who struggled to stabilize a country at war after dictator Saddam Hussein was ousted in the U.S.-led war.

Christof Heyns, the U.N. investigator on arbitrary executions, described the government-sanctioned executions as "arbitrary killing" that is "committed behind a smokescreen of flawed legal processes." He warned that the " continued lack of transparency about the implementation of the death penalty in Iraq, and the country's recent record, raise serious concerns about the question of what to expect in the future."

He made the remarks in a statement in August after more than two dozen people were executed in one week.

Since 2005, Iraq's government has executed 372 people, including at least nine women and number of foreigners convicted of terror charges, according to Justice Ministry data. The number of foreigners among those killed this year was not available.

In the last month alone, the government executed 26 people, including a Saudi, a Syrian and three Iraqi women. The executions were announced with no details about the names or trials of those who were killed, drawing widespread international denunciation.

Haider al-Saadi, the spokesman for the Iraqi Justice Ministry, said the death penalty is the best way for the Iraqi government to ease the suffering of the victims' families.

"The criminals in Iraq are not like the ones in Switzerland or other European Union countries or any others," he said. "Iraq today is facing the most dangerous terrorists in the world."

Iraqi courts have issued 867 death sentences since 2004, with most of them still on death row. The most prominent Iraqi to be executed since Saddam's fall was the dictator himself, hanged on Dec. 30, 2006, for his role in the 1982 killings of 148 Shiites following a failed assassination attempt in the early 1980s. A handful of his senior henchmen followed him to the gallows.

After the U.S.-led invasion in 2003, coalition authority officials suspended Iraq's death penalty, which Saddam and his Sunni regime had used to get rid of his opponents in the majority Shiite country. Shiites have led Iraq since, and in 2004 the transitional government reinstated capital punishment. Now, the government is showing increasing enthusiasm for the death penalty as a law-and-order tool.

Iraq was ranked fourth among the top five executioners in the world in 2011, according to London-based Amnesty International. It said most of those who were put to death were convicted of murder, kidnapping, rape and other violent crimes. China is on the top of the list, with thousands of people believed to be executed each year, followed by Iran and Saudi Arabia. The U.S. was ranked fifth.

Amnesty said the people executed in Iraq were sentenced in courts that "failed to meet international fair trial standards." It accused Iraq of issuing convictions in at least some cases that were based on torturing or otherwise coercing witnesses into giving statements against the accused. It has also said that some defendants were sentenced after trials that lasted just a few minutes.

U.S. auditors estimate American taxpayers have spent about $10 billion since 2003 to rebuild and strengthen Iraq's justice system after decades of Saddam's abuse.

Abdul-Sattar Bayrkdar, the spokesman for Iraq's Supreme Judicial Council, defended Iraqi courts as independent and immune to political pressures.

"We have a law and all our judges work according to it. All the trials and proceedings are according to the international law," he said. He added that "some" of the criticism is politically motivated and that "such allegations need proof."

Earlier this month, a Baghdad court found al-Hashemi, the vice president, guilty of masterminding the murders of an Iraqi lawyer and a security official ? killings that the government has described as among at least 150 bombings, assassinations and other attacks by his henchmen. He was sentenced to death by hanging. Al-Hashemi is living in exile in Turkey and has denied charges that he says amount to a political vendetta by his archenemy, the prime minister.

Baghdad-based political analyst Khadhum Muqdadi said Iraq's government has embraced the death penalty in recent years as a way to show the country is aggressive about going after terrorists, even though it fails to prevent the daily violence that has killed hundreds each month.

The government "has failed to dry up the sources of terrorism, to stop the attacks and to achieve security," Muqdadi said. "With these executions, it is trying to ease the pressure it is facing from the public opinion because of its failure to maintain security."
